A Nonimmigrant Religious Worker is a person who is not a citizen and who is temporarily entering the United States to work at least part-time (an average of at least 20 hours per week) as a religious worker or in a religious vocation or occupation.

Employment must be with one of the following:

  1. A nonprofit religious organization in the United States

  2. A religious organization authorized to use a group tax exemption by a group of tax-exempt individuals.

  3. A nonprofit organization affiliated with a religious denomination in the United States.

To be eligible, the individual must have been a member of a religious denomination associated with a legitimate nonprofit religious organization in the United States for at least two years immediately preceding the filing of the petition.

Duration: The R-1 status may be granted for an initial admission period of up to 30 months, with subsequent extensions approved for an additional 30 months each. The cumulative stay in the United States under R-1 classification is limited to a maximum of five years, or 60 months.

Family Members: The spouse and unmarried children under 21 years of age of an R-1 religious worker may be eligible for R-2 classification. R-2 dependents are not authorized to work based on this visa classification.

H-1B Visa
