
K1 Visa | Fiancé Visa
The K1 visa is a non-immigrant visa that initiates the process of bringing a foreign fiancé to the United States for the purpose of marriage. To qualify for the K-1 visa, both parties must genuinely intend to marry within 90 days of the fiancé's entry into the U.S. under K-1 status. The marriage must be a sincere commitment to build a life together, not merely to obtain immigration benefits.
Eligibility for the fiancé visa (K-1) is based on the following criteria:
The petitioner must be a U.S. citizen.
Both the petitioner and the fiancé must intend to marry within 90 days of the fiancé's entry into the United States on the K-1 visa.
Both parties must have the legal freedom to marry and must have legally ended any prior marriages.
The couple must have met in person at least once within the 2 years before filing the petition. This requirement may be waived under certain circumstances, such as cultural traditions or extreme hardships for the U.S. citizen petitioner.
Children of the Fiancé: Unmarried children under 21 can accompany the fiancé under K-2 visa status.
